Abstract:This article quotes data from 1991 to 2016 and statistics from 16 provinces(province-level municipalities) from 2000 to 2016, by analyzing the labor dispute cases and calculating the winning rate in China, so as to identify the main responsible party for the increasing number of labor dispute cases nationwide. This paper is devoted to reveal that: in China, the number of people and labor dispute cases, the number of people and collective dispute cases are generally on increasing trend; employers and employment units are the main responsible party of labor disputes; the main causes of labor disputes can be summarized as encroaching labor payment rights and social insurance rights, etc.; the compliance of alternation, rescission and termination of labor contracts. This article proposes the following suggestions. First, we need to take scientific coordination measures to improve the quality of institutional supply. Second, it is necessary to innovate the guidance mechanism of employers' responsibility. Third, we should exploit the value-leading function of institutional supply and shape the corporate culture of the new era.
